1. Scope
1.1 These terms and conditions of "M. Marquardt" (hereinafter "Seller") apply to all contracts concluded between a consumer or entrepreneur (hereinafter "Customer") and the Seller regarding the goods and/or services displayed by the Seller on its online shop or communication platforms. The inclusion of the Customer's own terms and conditions is hereby objected to, unless otherwise agreed.
1.2 A consumer within the meaning of these General Terms and Conditions is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession. An entrepreneur within the meaning of these General Terms and Conditions is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in exercise of their trade, business or profession.
2. Conclusion of Contract
2.1 The product representations on the website or on the Seller's online communication platforms do not constitute binding offers by the Seller but serve for the Customer to submit a binding offer.
2.2 The Customer can place an order via the online shop on the website, by contacting via email at rudelwohl@yahoo.com, or through the contact form on the website. This involves the individual customization of the desired product and communication of specific details.
2.3 Upon placing an order, the Customer automatically receives an email confirming receipt of the order ("Order Confirmation"). However, this does not yet constitute acceptance of the Customer's order by the Seller.
The Customer will be informed within five working days whether their order is accepted. In most cases, acceptance of the order occurs when the invoice is sent via email to the Customer. Additionally, dispatch of the ordered products also constitutes acceptance. The Seller will then send an email confirming that the products have been shipped ("Shipping Confirmation").
A binding contract between the Customer and the Seller, incorporating these general terms and conditions (the "Contract"), is formed earliest upon either the issuance of the invoice or the Shipping Confirmation.
2.4 The period for acceptance of the offer begins on the day after the offer is sent by the Customer and ends with the expiry of the fifth working day following the sending of the offer.
2.5 The contract language is exclusively German.
2.6 Order processing and communication typically occur via email and online communication platforms. The Customer must ensure that the email address provided for order processing is accurate and capable of receiving emails sent by the Seller. In particular, the Customer must ensure that all emails sent by the Seller or third parties appointed by the Seller for order processing can be delivered, including by adjusting spam filters accordingly.
3. Right of Withdrawal
3.1 Right of Withdrawal
According to §312g Para. 2 No. 1 BGB, we do not grant a right of withdrawal, as we allow our customers to reflect the character of their dogs in our products through size and individual color design. Each product is a handcrafted unique piece and therefore exempt from exchange, as personalized goods are economically worthless to our company after production, since the turnover due to customer specification and the thus individual production is impossible. Only in exceptional cases and by mutual agreement do we grant an extraordinary right of withdrawal within 14 days of receipt of the goods. 4. Returns
4.1 Would you like to return a product purchased from us? Please contact us via email at rudelwohl@yahoo.com. The cost of returning the goods is borne by the buyer.
5. Prices and Payment Terms
5.1 The prices stated by the Seller are final prices. Value added tax is not shown, as the Seller is a small business owner within the meaning of § 19 Abs. 1 UStG (German VAT law). Additional delivery and shipping costs will be communicated via email or through online communication platforms.
5.2 The only payment method available to the Customer is advance payment. Payment is due within 7 days of receipt of the invoice and can be made by bank transfer, PayPal, or in cash.
6. Delivery and Shipping Conditions
6.1 Goods are delivered regularly by shipping to the delivery address provided by the Customer. The delivery address provided in the Seller's purchase processing is decisive for the processing of the transaction. Delivery of the goods is initiated promptly after production. Shipping usually occurs within 20 to 30 working days, depending on the order situation. The standard delivery time from shipping is 7-14 working days. Rudelwohl sends the order as soon as all ordered products have been made. The Customer will be promptly informed of any delays. Shipping is insured.
6.2 If the transport company returns the shipped goods to the Seller because delivery to the Customer was not possible, the Customer bears the costs for the unsuccessful shipping. This does not apply if the Customer is not responsible for the circumstance leading to the impossibility of delivery or if the Customer was temporarily prevented from accepting the offered service, unless the Seller had announced the service to the Customer a reasonable time in advance.
6.3 In the case of self-collection, the Seller will inform the Customer by email that the ordered goods are ready for collection. After receiving this email, the Customer can collect the goods by appointment with the Seller at the Seller's premises. In this case, no shipping costs will be charged.
7. Warranty
7.1 The statutory warranty provisions apply. No warranty is assumed for damages caused by the Customer or their dog due to their own fault. The Customer bears the shipping costs for delivery and return of the goods.
8. Indemnification for Violation of Third Party Rights
If, according to the content of the contract, the Seller owes not only the delivery of the goods but also the processing of the goods according to specific specifications of the Customer, the Customer must ensure that the content provided to the Seller by the Customer for processing does not infringe the rights of third parties (e.g., copyrights or trademark rights). The Customer shall indemnify the Seller against claims by third parties that they may assert against the Seller in connection with an infringement of their rights due to the contractual use of the Customer's content by the Seller. The Customer shall also bear the reasonable costs of the necessary legal defense, including all court and attorney fees in statutory amount. This shall not apply if the infringement is not attributable to the Customer. In case of claims by third parties, the Customer is obliged to provide the Seller promptly, truthfully, and completely with all information necessary for the examination of the claims and a defense.
9. Miscellaneous
9.1 The contract is governed by the law of the Federal Republic of Germany. Should individual provisions of the contract including these General Terms and Conditions or parts thereof be or become invalid or should the contract contain a gap, this shall not affect the validity of the remaining provisions. The parties shall agree on an effective provision that comes closest to the economic purpose of the ineffective provision or, in the case of a gap, to what would have been agreed upon according to the sense and purpose of the contract including the General Terms and Conditions if the matter had been considered from the outset.
